Article 1 – Object

The izahobotanicals.com site is published by the company FLORIBIS-FRANCE, SASU with a capital of 10,000 euros whose registered office is at 87 Route de Saint Pancrace, 06100 NICE.

These conditions govern the sales by the company FLORIBIS-FRANCE of food and cosmetic products of the Izaho Botanicals brand.

The General Terms and Conditions are applicable exclusively to online sales on the izahobotanicals.com site, access to which is open. 

Article 2 – Pricing

The prices of our products are indicated in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding handling and shipping costs. 

In the event of an order to a country other than France or the European Union, you are the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be applicable. These rights and amounts are not the responsibility of the company. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to enquire about these aspects with your local authorities. 

All orders regardless of their origin are payable in euros.

Shipping costs are not included in the prices appearing in the Tariff and are payable in addition to these; they will then be invoiced according to the total amount of the order and the delivery method chosen by the Buyer.

The company FLORIBIS-FRANCE reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the current price at the time of validation of the order and subject to availability.

The products remain the property of FLORIBIS-FRANCE until full payment has been received. 

Please note: As soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you. 

Article 3 – Orders

You can place an order on the Internet: www.izahobotanicals.com. The contractual information is presented in French and will be subject to a confirmation at the time of validation of your order. The company FLORIBIS-FRANCE reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty regarding the order received.

Article 4 – Order confirmation

Any order appearing on the website: www.izahobotanicals.com implies acceptance of these General Terms and Conditions. Any order confirmation entails your full acceptance of these general conditions of sale, without exception or reservation. All the data provided, the confirmation and the recorded payment will constitute proof of the transaction. You declare to have perfect knowledge of it. 

Article 5 – Payment

The fact of validating your order implies that you have the obligation to pay the indicated price. A choice of several payment methods is offered. 

Article 6 – Retraction

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay a penalty. 

Returns are to be made in their original condition and complete (packaging, accessories, instructions), unopened product. In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. 

In case of exercise of the right of withdrawal, the company FLORIBIS-FRANCE will reimburse the amount paid at the time of return by wire transfer. In all cases, it will intervene according to the following methods: 

• The package is returned in its entirety, we will refund the price of the package and any shipping costs (standard delivery rate), return costs at your expense. 
• The package is not returned in its entirety (you keep one or more of the items ordered), we will refund the price of the returned product (s), any shipping costs are not refunded, the return costs remaining at your expense. 
• The product is returned because of our responsibility, we will refund the product, any shipping and return costs.

In the event that the right of withdrawal is exercised, FLORIBIS-FRANCE will reimburse the amount paid within 14 days of notification of your request and after receipt and inspection of the goods. 

Article 7 – Availability

Our products are offered as long as they are visible and marked “AVAILABLE” on the izahobotanicals.com website and while stocks last.

Article 8 – Delivery

Under normal conditions, the professional seller will process the order as soon as possible from Monday to Friday, excluding public holidays. The company FLORIBIS-FRANCE undertakes to ship orders within 24 working hours once they are confirmed and subject to stock availability. 

In order to facilitate the delivery of the order by the carrier, the customer undertakes to make the necessary efforts allowing the delivery of the package: name written on the mailbox, digital code transmission, telephone number.

Delivery times are indicative and remain dependent on carriers. The company FLORIBIS-FRANCE cannot therefore be held responsible in the event of late delivery. 

Please note that for deliveries outside the European Economic Area, any customs charges are your responsibility.

Moreover, depending on the country of delivery, restrictions by customs services may apply. 

Article 9 – Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 and following the Civil Code. In the event of non-compliance of a product sold, it may be returned, exchanged or refunded.

All complaints, requests for exchange or refund must be made by email within 30 days of delivery.

The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.). The shipping costs will be refunded to you on the basis of the invoiced price and the return costs will be refunded to you on presentation of supporting documents.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6. 

Article 10 – Liability

The products offered comply with current French legislation. The liability of the company cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered.

It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order.

Furthermore, the company cannot be held responsible for damage resulting from improper use of the product purchased.

Finally, the company cannot be held liable for all the inconveniences or damages inherent in the use of the Internet network, in particular a disruption of service, an external intrusion or the presence of computer viruses.

Article 11 – Applicable rights in the event of disputes

The original language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction. 

Article 12 – Intellectual property

All the elements of the izahobotanicals.com site are and remain the intellectual and exclusive property of the company FLORIBIS-FRANCE. No one is authorized to reproduce, use, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of the company FLORIBIS-FRANCE. 

Article 13 – Personal data

FLORIBIS-FRANCE reserves the right to collect nominative information and personal data concerning you. They are necessary to manage your order, as well as to improve the services and information we send you.

They may also be sent to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and personal data concerning you, directly on the website. 

Article 14 – Archiving proof

FLORIBIS-FRANCE will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The computerized registered documents of the company FLORIBIS-FRANCE will be considered by all the parties concerned as proof of communications, orders, payments and transactions between the parties.
